Home Health and Hospice Agencies Prohibited from Paying Nurses on 'Per-Visit' Basis
March 2010

On March 26, 2009, the Oregon House of Representatives passed House Bill 2895. The Bill becomes law effective January 1, 2010. Under the new law, home health and hospice organizations are prohibited from compensating nurses on a per-visit basis. The Bureau of Labor and Industries has been charged with enforcing the new Bill. On November 1, 2009, BOLI proposed new rules to comply with HB 2895.

The proposed rules for HB 2895 can be found on BOLI's website: http://www.boli.state.or.us/BOLI/LEGAL/H_Notices.shtml. BOLI is currently accepting public comments. Comments can be sent via regular mail to Stef Plebanek c/o BOLI, 800 NE Oregon St. #1045, Portland, OR 97232 or via email to plebaneks@state.or.us.
